The regular meeting of the Board of Directors was held on Tuesday, August 13, 2024, at Scooters, 2750 Miracle Mile, Bullhead City, AZ.  The meeting was called to order at 11:45 p.m., by President Larry Adams.               

Attendees

President Larry Adams, Secretary/Treasurer John Caponetto, Directors Bob King and Mike Williams.  Absent:  Directors Catherine Lopez-Rajaniemi, Shane Chester, Michel Adams, and Larry Ojeda.      

Minutes

President Adams asked if they read the Newsletter.  President Adams asked for a motion to approve the July Board Minutes.  Director Bob King made a motion to approve the July Board Minutes.   Director Mike Williams seconded the motion.  All were in favor.  Motion passed.       

Treasurer’s Report

President Adams asked for a motion to dispense reading of the Treasurer’s report until tomorrow night’s general meeting.  Secretary/Treasurer John Caponetto made a motion to dispense reading of the Treasurer’s Report.  Director King seconded the motion.  All were in favor.  Motion passed.

Old Business

President Adams said the addition to the Academy of Building Industries School is being constructed.  Concrete has been poured.  Walls will be framed by Thursday.

President Adams said that the primary election is over.  Chris Morgan and Catherine Lopez-Rajaniemi were defeated.  Ron Gould won by a landslide.  Politics on the local level settled. 

President Adams informed the Board that Proposition 416 passed.  A PACT was formed to advertise this proposition.  He said that city employees are not supposed to endorsed this proposition.  Strict violation of voting laws. 

New Business

President Adams said he received a membership application from Shurte Construction.  Short discussion was held.  President Adams asked for a motion to approve the membership application from Shurte Construction.  Director King made a motion to approve the membership application from Shurte Construction.  Director Williams seconded the motion.  All were in favor.  Motion passed. 

President Adams passed out a flyer from the Laughlin Chamber of Commerce They are asking for sponsors for a book they are putting out entitled “The House That She Built”.  Sponsors will have their logo added to a sticker insert inside cover of book.  President Adams said that the Mohave Valley Contractors Association should be a sponsor and contribute $600 as a sponsor.  President Adams asked for a motion.  Secretary/Treasurer Caponetto made a motion to have the Mohave Valley Contractors Association be a sponsor and contribute $600 as a sponsor.  Director King seconded the motion.  All were in favor.  Motion passed. 

Guest Speakers

President Larry Adams said that Joe Bardswich of Golden Vertex will be our guest speaker for tomorrow night’s dinner meeting.   

President Adams passed out a letter that will be send out by the Mohave Valley Contractors Association to all the contractors residing in Fort Mohave, Mohave Valley, Bullhead City and Kingman.  He said that there are over 400 contractors that they found.  The letter being send out in a letter of introduction to the Mohave Valley Contractors Association and a membership application will go with the letter.  The back of the letter has our Mission Statement.  President Adams said his assistant did all the research and got addresses and will be mailing this out.

Treasurer’s Report

President Adams asked for a motion to dispense reading of the Treasurer’s report until tomorrow night’s general meeting.  Director Shane Chester made a motion to dispense reading of the Treasurer’s Report.  Director Larry Ojeda seconded the motion.  All were in favor.  Motion passed.

Old Business

President Larry Adams said that there were three bids, by invitation only, for the construction of the addition to the Academy of Building Industries school.  Pueblo Construction was the lowest bid and, as such, was awarded to Pueblo Construction.  There has been a delay in getting building permits because the Mohave County wants a lot of inspections done on the hood range and they need certification from them.   President Larry Adams said that grading and the pouring of concrete will soon begin.  It has taken eight months to get to this point.  School will be out until August 5th s they are trying to get as much done before then. 

President Larry Adams asked how many of the Board members lived in the city as citizens are supposed to either approve or disapprove Proposition 416.  He said that the Arizona Legislature passed a spending limit on base rate in 1980 and that they can’t exceed spending limit.  President Larry Adams also said that the 416 Pact is spending a lot of money on this and said that the Pact have to divulge who is contributing to this 416 Proposition.  He also said that city employees are on social media to pass 416 Proposition.  They are stretching it as the city is not allowed to advertise this. 

New Business

President Larry Adams showed the Board Members a page from the Arizona Republic newspaper titled “Gas fired power plant fuels unrest, suspicion in Mohave County”.   Further down the page, a paragraph read, “In 2022, Tyler Carlson, MEC’s CEO, received a base salary of $1.35 million, more than the $1.2 million that SRP, Arizona’s much larger urban utility company, paid its CEO, which some viewed as odd”. 

There was a discussion on MEC’s rates and also on the time that MEC’s Board of Directors hold their positions.

Old Business

President Larry Adams said that they will be finding out on Friday regarding the bid for the Academy of Building Industries school.  We should know by next week who the contractor will be. 

New Business

President Larry Adams said that the new bridge is now open.  He said it was to alleviate traffic on Highway 95.  It cost around 65million to build the bridge.  He shared that the Phoenix TV station showed the opening of the new bridge.   

President Adams talked about the signs around the city to support Proposition 416.  This is to exceed statutory spending limits on cities.  The city wants to have this put on the ballot to have voters approve overspending.  President Larry Adams also said that they have to have a Pact to put out signs.  Signs have to have a Pact listed.  He also said the city has adjusted the rates for water meters.  Under EPCOR, the price was $300.  Under the city, the price went up to $7,000. 

Conversation was held regarding that they all have noticed that construction of houses has really slowed down and that houses being built their prices have really gone up and the time to build houses is taking longer because of permit delays and material costs.

President Larry Adams stated that we have three candidates that are running for City Council for the City of Bullhead City.  They are Linda Saldana, Eugene O’Neill, and Annette Wegmann-Wood.

Old Business

President Adams that the City Council passed the 2018 Building Codes and they will go into effect July 1st.   President Adams said that he had been in a meeting with the City Council and no one asked any questions regarding the 2018 Building Codes.  Affordable housing will not be built if they keep changing the building codes that will make it more difficult to build affordable housing. 

New Business

Secretary/Treasurer John Caponetto informed the Board on the Academy of Building Industries school progress.  He said that the Mohave County won’t issue permit until the architects make three changes to the plans submitted.  The changes are: grading permit; site plan; and truss confirmation for an authorized person to inspect hood. Secretary/Treasurer John Caponetto said if he gets the architects to do the changes, he can then submit the plans to the county.  Secretary/Treasurer John Caponetto said he wants President Larry Adams to go over the plans for the hood to make sure the he’s doing it right.  Secretary/Treasurer John Caponetto also said he wants to have an Academy of Building Industries school committee involving at least three people from the Mohave Valley Contractors Association.  Right now, Secretary/Treasurer John Caponetto is the liaison for the Academy of Building Industries school Governing Board. 

President Adams said that the Registrars of Contractors Advisory Council held a virtual meeting where it was discussed about a bill being sent to the Legislature regarding deregulating commercial contractors.  President Larry Adams said he has talked with Tom Cole, the Interim Registrar of Contractors.  President Larry Adams said he feels that Tom Cole is trying to do a good job, considering his experience is being a fire fighter. 

Guest Speakers

President Larry Adams said that there will be four guest speakers for tomorrow night’s general meeting.  They are running for a position on the City Council.  There are seven people running for these positions.  We will have the other three to be our guest speakers for next month’s general meeting.  The four persons making their presentations are:  Jason Newlin, Karen Dalman, Rodney Head, and Juan Lizarraga. 

President Larry Adams brought the subject up regarding the City of Bullhead City competing with city business owners using tax payer monies.  They are selling food and are asking for a liquor license contrary as to what the city should be doing. 

President Larry Adams said that we don’t contact contractors to join the Mohave Valley Contractors Association.  President Larry Adams said that his assistant Jennifer got a list of residential and commercial contractors.  Let’s see if we can get them to join the Mohave Valley Contractors Association.  It was mentioned that we should another flyer regarding what the Mohave Valley Contractors Association does.  We should start with networking with our own people. 

Secretary/Treasurer John Caponetto said that our insurance for our association is due.  For both policies it is $2979 that he will be paying.

2018 Building Codes

President Adams informed the Board that the City of Bullhead City is moving ahead to implement the 2018 Building Codes.  They said they want to keep up with the times.  We have been using the 2006 Building Codes for years without and problems.  We are still going to voice our opposition.

New Business

President Larry Adams said that he did not attend the Registrar of Contractors Advisory Council meeting.

Guest Speakers

President Larry Adams said that our guest speakers for tomorrow night’s general meeting will be Rich Littman and Grace Hecht, candidates for Mohave County Board of Supervisor for District 2. 

President Larry Adams said that next month’s guest speakers will be candidates for Mohave County Board Supervisor for Districts 4 and 5.

Secretary/Treasurer John Caponetto showed the Board a Tri State Booklet by Legacy Arizona Charitable Tax Credit and has enough of these booklets to pass out to the members at tomorrow night’s general meeting.

President Adams said he has not heard back from the City of Bullhead City to see if they are going to implement the use of 2018 Building Code.

President Adams talked about the Registrar of Contractors situation.  He said that the temporary Director of the Registrar of Contractors is Tom Cole, who retired from the fire services.  Has no experience as a contractor.  President Adams said that he will be attending the Advisory Council next Tuesday.  President Adams said that at the last meeting that he attended Tom Cole said that they are going to waive license fees for veterans, disabled, and economically disadvantaged people.  President Adams wanted to know who is checking to make sure that people are qualified for a license.  They are hiring retired police officers for investigators and they have no construction experience.    

New Business

Secretary/Treasurer Caponetto informed the Board that he called the architects to find out where the building plan is for the Academy of Building Industries school.  It has been a year since this all started. 

Director Lopez-Rajaniemi informed the Board that the fire department in Fort Mohave purchased land for a new fire station.

President Adams said that our guest speaker for tomorrow night will be Bo Hellams, Director for the Bullhead City Chamber of Commerce

President’s Letter

The new acting registrar of contractors, Cindy Casaus, has reactivated the industry’s advisory board to the registrar’s office. The advisory board was first constituted by Mike Goldwater and functioned effectively for 25 years before being terminated by Jeff Fleetham around 2015. Mr. Fleetham apparently did not feel a need to have industry input in his office. The Mohave Valley contractors took an active part in the advisory board from 1991 until about 2014. At any rate, we have been granted a seat on the new board and we will take an active role with the registrar.

The city of Bullhead City is actively seeking a grant of three-hundred million dollars ($300,000,000.00) to install infrastructures to take water directly from the Colorado River rather than pumping ground water, as we currently do now. As I understand it, we would have to give up part of our annual water allocation to receive this grant. Without explanation for this action, I fail to see how the City of Bullhead benefits from this proposal. I have invited Mark Clark, Bullhead’s Director of Utilities, to be our guest speaker at our Wednesday, October 11th, meeting. At this time, he has not confirmed his attendance, but if he cannot make it, I will try to get someone else from the city to address this proposal.

Treasurer’s Report

Old Business

President Adams informed the Board that the new acting Registrar of Contractors, Cindy Casaus, met with the Board and some of the items discussed were unlicensed contractor activities, what it takes to get a license, and licensing process.  They also took a tour of the Academy of Building Industries school. 

New Business

Secretary/Treasurer Caponetto said that on September 5, 2023, water allocation was approved by MVIDD.  The application fee was $763.80, and he will let the school know how much it cost.  Secretary/Treasurer Caponetto said he called Jaime Kelley appreciating her offer of water allocation to the school and will send a written letter to Ms. Kelley thanking her, but that they got an offer they couldn’t refuse.

Secretary/Treasurer Caponetto said he heard from Selberg Associates that they got replies from Mohave County regarding the site plans.  Some of the items mentioned were that the font on the site plans were too small, wrong zone classification, needed dimensions for parking lot.  They had a list of eight items that Mohave County sent to Selberg Associates.  Secretary/Treasurer Caponetto will track this.  He also said that he has heard nothing from ADOT.

President Adams said that Mohave County has gotten impossible.  How many months has it been to get site plans approved?  We had to spend an additional $3,000 to Selberg Associates to get site plans approval. 

Secretary/Treasurer Caponetto said he read in the newspaper that the Board of Supervisors have approved a recommended approach by the building department to an alternate method of evaluating soils.  He said he talked to Gibert at Mohave County and Gilbert said that they are doing soils evaluation tests instead of Geotech testing of soils.  The soils evaluation tests are less restrictive.  The cost will be three to four hundred dollars. 

Secretary/Treasurer Caponetto said that we made $1,132 on our CD of $70,000 at 5% for four months, with Foothill Bank, and he is renewing the CD for another four months at 5%.  President Adams has to go to the bank and sign the papers for the renewal.

President’s Letter

Cindy Casaus, the acting Registrar of Contractors, stayed true to her word and was in Bullhead City on August 21st. Several of our members met with Cindy at the library prior to a scheduled meeting of the public concerning the dangers of using unlicensed contractors. Unfortunately, I was unable to attend the meeting, as I was ill with a third round of Covid. Both meetings went well, and we are grateful for the opportunity to have had a private meeting with Cindy to discuss our concerns with the Registrar’s Office directly with the head of the agency. 

John Caponetto gave Cindy a tour of the Academy of Building Industries following the meeting at the library. The registrar had heard of the school and was very much interested in it. I think it is safe to say that the registrar was very impressed with our facility, the students and the staff that run it. The school is unique to Arizona and certainly the only one to have been founded by a contractor’s association. The registrar has been invited to speak at one of our regular monthly meetings that will happen in the near future. 

Our scheduled guest speaker for our August dinner meeting, Arizona Representative Leo Biasiucci, previously forgot about the event where we did not wind up with a speaker. We will, however, have another opportunity at this month’s dinner meeting on September 13th to hear him speak. He will be updating us on the accomplishments of the last legislation session, or lack thereof. This promises to be a very informative meeting so I hope you will plan to attend. The regular meeting of the Board of Directors was held on Tuesday, August 8, 2023, at Scooters, 2750 Miracle Mile, Bullhead City, AZ.  The meeting was called to order at 12 p.m., by President Larry Adams.     

Attendees

Minutes

President Adams asked everyone if they read the Newsletter.  President Adams asked for a motion to approve the July Board Minutes.  Director Chester made a motion to approve the July Board Minutes.   Director Frederickson seconded the motion.  All were in favor.  Motion passed.    

Treasurer’s Report

President Adams asked for a motion to dispense reading of the Treasurer’s report until tomorrow night’s general meeting.  Director Frederickson made a motion to dispense reading of the Treasurer’s Report.  Director Chester seconded the motion.  All were in favor.  Motion passed.

New Business

President Adams asked if there was any progress for the Academy of Building Industries school site plan.  Secretary/Treasurer Caponetto said that the site plan has been submitted to Mohave County and was in review.  He said it takes 30 days to five months to be approved.  Secretary/Treasurer Caponetto said that they are getting an application for water and in a month or so will have it all resolved.  He said that Jeremiah Perkins of Clear Circuit has a farm and is donating an acre of water to the school.  President Adams said they will send a letter to Jaime Kelly thanking her for allocating water to the school and allowing us the opportunity to purchase water from her properties. 

President Adams informed the Board that it now costs $7,000 for acre/ft.  It used to cost $1,000 acre/ft.

President Adams said that Rob of Selberg Associates wanted another $3,000 to deal with the County for site plan.  President Adams said too much time to get confirmation of approvals for site plans. 

Everybody is having problems with Mohave County’s permitting process.  Contractors are reluctant to complain for fear of retaliation by the County. 

President Adams informed the Board the new acting Registrar of Contractors is Cindy Casaus.  She will be holding a public meeting on August 23rd at the Library.    President Adams said that he and some of the Board Members will be meeting with her at 9am at Pueblo Construction.  She also requested a tour of the Academy of Building of Industries school. 

Membership Application

Secretary/Treasurer Caponetto said he received a membership application from Larry Ojeda of L&D Excavation LLC.  President Adams asked for motion to accept the membership application.  Director Chester made a motion to accept the membership application from L&D Excavation LLC.  Secretary/Treasurer Caponetto seconded the motion.  All were in favor.  Motion approved.

President’s Letter

It appears we cannot go a month without losing our contractors. Although he was not ever a member of our association, Jim Roundtree was a general contractor for several years. It is reported that Jim was killed in an automobile accident on his way back from the state of Washington in early July. 

Apparently, there is a new interim director for the ROC by the name of Cindy Casous. Director Casous has indicated that she will be holding a public meeting on August 23rd at the Bullhead City library starting at 10:30AM. She will be discussing the importance of hiring licensed contractors and the public is invited to attend. I and some of the board members will meet with the director prior to the public meeting at the Pueblo Office. Director Casous has also requested a tour of the A.O.B.I and we will certainly arrange that, and we are pleased that she has expressed interest in our school. 

The Arizona State Legislator finally adjourned its 2023 session on July 31st. I believe this is the longest session in the history of the state. Our guest speaker this month will be Leo Biasiucci, one of our district 30 representatives to the state legislature. Leo will be talking about this past legislation session and what has and has not been accomplished. Make your dinner reservations today as this will be a most interesting presentation.

Secretary/Treasurer John Caponetto asked everyone if they had read the Newsletter. Attendees agreed on the contents of the newsletter.  No formal motion was made to approve as there was no quorum present.

Treasurer’s Report

Secretary/treasurer Caponetto suggested that the treasurer’s report reading be postponed until the regular dinner meeting.  Attendees were in agreement.  No formal motion was made to approve as there was no quorum present.

New Business

Secretary/treasurer Caponetto informed the board that the speaker for tomorrow’s general meeting is not known at this time.

Director Catherine Lopez-Rajaniemi passed out a flyer regarding Mohave County Fire Officer’s Association voting to explore county-wide Joint Powers Authority. A general discussion ensued regarding aspects of this proposal.  Director Catherine Lopez-Rajaniemi will bring more flyers on this subject for tomorrow night’s meeting.

Secretary/treasurer Caponetto said that at present time, there are no MVIDD contract forms for allocation of water from private owner (non-farm allocations) to private owner. They are trying to develop language to permit owners of privately held water allocations to transfer water allocations to other privately held lands. Presently, water allocations can only be transferred from farming entities. To acquire a water allocation from MVIDD, a contract needs to be negotiated between the transferor and transferee, and an application submitted to MVIDD.  Secretary/treasurer Caponetto said that we may be able to purchase a 1-acre-foot water allocation from Jamie Kelley for the Academy of Building Industries School.  Secretary/treasurer Caponetto will attend a zoom meeting with MVIDD tomorrow regarding progress of new contract and application language.

Secretary/treasurer Caponetto said that Selberg Associates is working on the site plan for the building addition for the Academy of Building Industries school, and submission to Mohave County for approval.

Secretary/treasurer Caponetto said that he is still researching appliances for the kitchen. The school is still working on application for a school lunch program which appears to be based on local demographics.

President’s Letter

I sincerely hope everyone had an enjoyable 4th.  It is a time to remember the birth of the greatest free country in the world and it is up to us to keep it that way.  The 4th is also a day to hopefully spend with family and neighbors, as well as enjoying fireworks over the river as I was able to do.

We are still working to get construction started on the school expansion and it looks like that will happen in the near future.  

I see that A.D.O.T. has started the resurfacing of Hwy 95 from bridge to bridge.  This project is certainly long overdue, and I suppose we can live with the inconvenience of construction long enough to get it done.  

The guest speaker for our dinner meeting is not yet confirmed, but I am trying to get our newest Bullhead City Councilman, Rich Lettman, as our speaker.  As you know, Rich is one of us as he is the owner of Coit Cleaning and Restoration.  Rich was appointed to the City Council to fill the term of Norma Brumett, who recently passed away.  It will be interesting to hear what Rich envisions as a future for Bullhead City.

Old Business

President Adams asked Secretary/Treasurer Caponetto to inform the board regarding the Academy of Building Industries School Board meeting held last week.  Secretary/Treasurer Caponetto said he talked to Jamie Kelley who is the attorney the Mohave County Water Authority regarding 15 acre-feet of water that she holds with the Mohave Valley Irrigation and Drainage District that could be re-allocated to other properties.  She has a six-month extension to determine how and when she can re-allocate the water.   Secretary/Treasurer Caponetto said he wrote a letter to Jamie Kelley asking her to sell a portion of her water to the Academy of Building Industries School.

Secretary/Treasurer Caponetto said that at the present time there are no MVIDD contract/application forms to allocate water to other properties.  MVIDD is currently trying to develop language for owners of a water allocation to allocate water to other owners of property.  He will continue to work with Jamie Kelley and then acquire the new developed contract/application form from MVIDD.  President Adams said that he didn’t think that acquisition of the needed water allocation for the school would be a problem with MVIDD.  We have to buy water. There was an additional discussion regarding the water allocations held by Bullhead City and how it is stored.

Secretary/Treasurer Caponetto said that he received an estimate for development of the architectural building plans for the Academy of building Industries School at the amount of $88,800.00.  This amount was simply ridiculous, and an alternate bid was acquired from Selberg Associates at a much more reasonable price. Development of the project site plan is a real hurdle with added difficulty in trying to get anything done at the County.

Guest Speaker

President Adams said that our scheduled speaker was going to be Martin Quesada, Governor Hobb’s appointed director as Registrar of Contractors.  The Senate rejected his appointment.  President Adams said he has a call to Leo Biasiucci to find out about this.  Mohave County Sheriff Doug Schuster will be our guest and he will discuss the proposed quarter-cent sales tax increase to support the Sheriff’s Department.

New Business

Secretary/Treasurer Caponetto made a note that Charles Lopez of Mohave Electric has not been appointed to the board.  President Adams said for him to keep on coming to the board minutes and if he wants, he can be formally appointed.
